Alternative Dispute Resolution

An alternative to litigation is alternative dispute resolution which includes both mediation and arbitration. Mediation is a process by which a third party (the mediator) facilitates the negotiation of a dispute between two parties. Mediation is non-binding, which means that the mediator’s ideas are only recommendations to the parties, not directives. Mediation often takes place in conjunction with litigation in court as a vehicle for attempting to resolve conflicts prior to trial. In contrast, arbitration is a process by which an arbitrator hears both sides of a case and makes a determination as to which party should prevail. Arbitration is in lieu of a trial with a judge and/or jury. Our attorneys have experience mediating and arbitrating cases on behalf of clients as well as acting as mediators and arbitrators for third parties.
